As part of an ongoing effort to strengthen California State University practices, the CSU Board of Trustees unanimously approved two new policies to strengthen and clarify employment practices:

“In addition to being at the forefront of improving and expanding student achievement, we are committed to taking steps to ensure that CSU is a national leader in all areas of university operations and governance,” said Wenda Fong, CSU Board Chair. Trustees: CSU acted promptly and decisively to address issues in both of these areas by revising or implementing new practices, and this new policy will help further clarify and secure these topics across the 23 campuses and the chancellor’s office.”

The opportunity to “step down” to a faculty position is often offered to professors who are required to give up tenure to become university administrators. The option to step back allows a new administrator to return to a teaching position when their administrative role at the university ends. New or continuing administrators often negotiate the possibility of stepping down for the term of the administrator’s employment because university administrators, unlike tenured faculty, are at-will employees with no guarantee of permanent employment.

The employment policy governing the retreat option for administrator employees includes the following guidance:

– An administrator will not be eligible to exercise this option if there is a finding of misconduct or the administrator is under investigation for misconduct.

– Mention of retreat dates will be placed in the administrative appointment letter.

– Consultation should be held with the tenured faculty of the appropriate faculty to which the individual may return.

The policy applies to all administrator appointments made on a CSU campus or in the chancellor’s office that include the option to retire from a faculty position. The policy is intended to be prospective and does not affect withdrawals made prior to its effective date, except in the event of a serious breach of the policy on a case-by-case basis.

“These new policies are important steps that will allow us to better focus on our core mission of improving the lives of Californians through the transformative power of higher education,” added Interim Chancellor Jolene Kester.

The employment policy governing the provision of employee references, another policy approved by the trustees, outlines the principles and procedures that guide the provision of references. In accordance with policy, CSU will not issue a positive reference, verbal or written, to any current or former employee who has committed significant misconduct resulting in suspension, is currently under investigation for a violation or violation of University policy, or is under Public Employees Retirement have had their pension benefits revoked under the reform law for criminal misconduct in relation to their official duties.

The policy further provides guidance on references requested by third parties, employment verification of current or former employees, personal references and references within CSU.

Both policies will soon be added to CSU’s policy library, and all 23 campuses and the chancellor’s office will begin implementation immediately.
