Man pleads not guilty to involuntary manslaughter in downtown San Diego bus death

A man accused of fatally injuring another passenger on a downtown San Diego bus pleaded not guilty Tuesday to a charge of involuntary manslaughter.

Edward Hilbert, 55, is charged in the May 1 death of 28-year-old Anthony McGuff.

Investigators said the bus was on F Street near 14th Street when McGough and a female passenger got into an argument. Hilbert saw the fight and intervened, police said.

Hilbert ended up restraining McGaffe for several minutes during which McGaffe was knocked unconscious and in medical distress, police said. Someone called 911 to report the fight and McGough was unresponsive on the floor when officers arrived. He was taken to the hospital, where he died, according to police.

Hilbert was arrested on suspicion of murder, but the San Diego County District Attorney’s Office did not immediately file charges in the case.

While no new details about the fatal encounter were shared in San Diego Superior Court during Hilbert’s arraignment Tuesday afternoon, Deputy District Attorney Matthew Greco said Hilbert was “engaging in a lawful act that he committed in an unlawful manner.” .

The prosecutor said outside the court, “it is important to understand that when someone gets involved to protect someone else, that it is not white to commit any act, that there are limits.”

Hilbert, who remains out of custody, faces up to four years in prison if convicted.

Defense attorney Heather Boxeth said after the hearing, “We are extremely disappointed in the District Attorney’s charge for what turned out to be a tragic accident.”

According to the lawyer, Hilbert was not the only passenger on the bus “who helped defend a woman who was attacked.”

“I think that makes it very clear that you don’t want to act as a Good Samaritan … it sends a very bad statement to the community,” Boxeth said.
