Man denies DUI charge for Balboa Park crash that killed cyclist Laura Shinn

San Diego (CNS) – A man suspected of driving under the influence of methamphetamine Gives a fatal blow to a cyclist Balboa Park acquitted Thursday on charges of including murder.

According to police, Shin was struck from behind while riding a parsing drive around 7:30 am. According to the coroner’s office, she was taken to Scripps Mercy Hospital in Hillcrest and sentenced to death shortly after arrival.

Police said Mirabets stayed on the scene and worked with investigators.

In Mirabets’ prosecution, Deputy District Attorney Kelsey Hollander claimed he was in the bike lane when Shin was beaten and had lights on both his bike and his helmet.

After the crash, prosecutors said Mirabets got out of the car, ran across the street, and threw two bags over the fence. According to Hollander, the bag was later recovered by police, who discovered “what looks like methamphetamine.”

Mirabets also showed “affected signs and symptoms” of the drug when police met him, she said.

According to Hollander, Mirabets was arrested on July 1 for misdemeanor drunk driving and was believed to be driving under the influence of methamphetamine.

Douglas Miller, acting public defender, claimed in Mirabets’ prosecution Thursday that Mirabets would be released from detention at his own discretion or in an indictment program. He claimed the crash was an accident and said Mirabets stayed at the scene and refused to flee the authorities.

Miller argued that the defendant was not a flight risk, but Hollander said Mirabets had dual citizenship in the United States and Canada.

Judge Joseph Branigan of the San Diego Superior Court has finally ordered Mirabets to be detained without bail, although a bail hearing was set up next week.

In addition to the murder, Mirabets has been charged with manslaughter while driving drunk and under the influence of injuring drugs.
