Kanye West and Kim Kardashian set for showdown in court as he attempts to challenge prenup

Kanye West is set to challenge its prenuptial agreement with Kim Kardashian in an apparent attempt to explain her efforts to single herself.

The 44-year-old rapper’s lawyers have filed legal documents claiming that all marriage contracts were signed in California after 2002 are deemed to be invalid, TMZ reported on Tuesday.

Kardashian, 41, will ask a judge to declare her legal single on Wednesday, March 2, the outlet reported.

Delay tactics: Lawyers for Kanye West, 44, filed documents claiming that all prenuptial agreements signed after 2002 – including his agreement with Kim Kardashian, 41 – were invalid, TMZ reported Tuesday; West and Kardashian seen in 2020

“California marriage agreements entered into on or after January 1, 2002, are presumably invalid,” West’s lawyers argued in his application. ‘The suspicion of invalidity exists until it is refuted in court or the parties ratify the agreement. We are in the early stages of the case, so no ratification has taken place. ‘

However, West has not previously claimed that his agreement with Kardashian is invalid.

According to the outlet, California law requires one of the spouses to challenge the marriage contract to be invalid, but the Monster rapper has not yet done so.

If he did so, he would have to prove that the agreement was ‘unusual’, that is to say that it was too one-sided, or that one of the two parties did not voluntarily agree to it.

TMZ notes that West had a lawyer who represented him when he signed the agreement, suggesting that his signature was not involuntary.

The document is also expected to help him maintain much of the massive fortune he accumulated during his marriage to Kardashian, which comes from several hit albums and his lucrative fashion offerings.

West-ex has previously submitted documents claiming that his recent posts on social media were full of ‘wrong information’, and she claimed that her attacks on her and her friend Pete Davidson caused her ’emotional distress’.

“I believe the court that ends our civil status will help Kanye to accept that our marital relationship is over and move forward on a better path that will help us in the peaceful co-parenting of our children,” Kardashian wrote in documents submitted on February 23, according to Rolling stone.

Kardashian uses her estranged husband’s messages on social media as an argument to speed up her transition to single status, but West’s lawyers said she would have to prove he wrote the messages in person, although she did not appear to explicitly deny that he had written. them in their own files.

‘Kim claims she read something online after all by Kanye and characterizes the messages in her statement as misinformation. The posts on social media are not attached to the statement. Kim had to present the messages on social media as evidence, showing that the messages were written by Kanye, ‘his lawyers wrote, adding that Kardashian’s claims are’ double hearsay ‘.

Although West’s lawyers seem to be raising doubts about whether he is responsible for posts on his social media account, he seems to have taken steps in his posts to cast himself as its author.

In a recently deleted Instagram post, the hitmaker shared a photo of himself with a yellow notepad that read, ‘My account has not been hacked,’ and the date, ‘2 13 22.’

The caption of the posts contained the recognizable breathless style with all the capitals to which many of West’s recent posts have adhered.

“MY ACCOUNT IS NOT HACKED,” the post was repeated in the title, before stating that West would take his children to Sunday service, followed by the Super Bowl.

He also included a non-SNL Weekend Update anchor Michael Che who offered to pay him double ‘WHAT THEY PAYING YOU’ to get him away from cast member Pete Davidson.

Sources argued against TMZ that the musician and fashion designer did not work closely with his legal team.

Instead, he made it clear that he did not want to divorce Kardashian, but left it to his lawyers to create a legal strategy for him.

Source also said it is unlikely he will appear in court on Wednesday for the hearing.

Kardashian filed for divorce in February 2021, and the couple initially seemed to be on the same page, but in recent weeks, West has attacked her friend on social media.

Unrelenting: Kardashian begged him over text: 'Why can't you keep any of our conversations private ???' and he replied: '' Because I got a text message from my favorite person in the world ''
