Former Official of Border Patrol Union Convicted of Theft and Fraud

A federal jury in San Francisco found the former president of the union representing customs officers and border guards in California and Nevada guilty of stealing money from the union and lied about it to federal agencies.

Jonathan Ortino, 47, of San Bruno, former president of the National Finance Workers Union Chapter 165, was convicted of two counts of making false statements and three counts of network fraud in connection with a plan to defraud the union and conceal the fraud by filing. The jury acquitted Ortino of one section of false statements. The verdict was handed down after a five-day trial of a jury before USD District Judge William Orrick.

The case was the result of an investigation by the Department of Homeland Security and the Ministry of Labor into work management standards.

The evidence presented at the trial proved that, as of February 2014, Ortino wrongly took more than $ 84,000 from union funds, using them on himself, his wife, his friends and other associates.

The evidence also showed, according to Hinds, that Ortino falsely reported to the Ministry of Labor the amount of money paid to him in 2014 and 2016.

In June 2019, a large federal jury returned an indictment accusing Ortino of three counts of making false statements to a government agency and three counts of fraud. After the trial, the jury convicted Ortino of five counts – all three counts of retaliatory fraud and two of the three false statements.

Ortino faces a maximum statutory penalty of 5 years in prison and a fine of $ 250,000 for each section of false statements and a maximum statutory penalty of 20 years imprisonment and a fine of $ 250,000 for each section of fraud.

Also, in the context of the Ortino sentence, the court may order a period of release under supervision, restitution and additional assessments.
