Former Santa Clara City Councilman Dominique Caserta, who is facing a restraining order for fraud and forgery, has filed bail in San Benito County, according to prosecutors.
Caserta will be prosecuted on May 13 in the Santa Clara County Supreme Court in Palo Alto, said District Attorney Steve Dal Porto.
Caserta is represented by Sam Fulbrino, a well-known criminal lawyer in San Jose.
Supreme Court Justice Paul Bernal signed a $ 30,000 arrest warrant on Feb. 16, based on charges filed in January by the Santa Clara District Attorney’s Office.
Caserta is accused of forging six Foothill-Deanza Community College pay slips for 2021 – even though he last worked at the college in 2019 – in an attempt to get a $ 690,000 loan from Finance of America Mortgage.
He is also charged with filing a false 2021 employment verification form, in which he said his salary for a year as a part-time instructor was $ 81,142, and a district employee signature signature.
Caserta’s response could not be obtained, and Fulbrino did not respond to inquiries.
Caserta, 47, is a former high school teacher who ended his campaign for district commissioner and retired from public life in 2018 after San Jose Inside released interviews with several women who accused him of sexual misconduct.
Prosecutors in August 2018 decided not to file a criminal indictment against Caserta after investigating the complaints of sexual conduct.
A leaked manpower case that reached San Jose Inside in May 2018 showed that Caserta had been heard by the Santa Clara District School District several times since 2002 for sexually harassing students, and at least 15 people had filed police reports against him. As a result of the public reaction, Caserta left his teaching role at Santa Clara High School and local community colleges, retired from the race for Santa Clara County Superintendent and resigned from Santa Clara City Council.
He is registered as a Lecturer in Political Science at the University of San Francisco State, where he earned a master’s degree. He received a bachelor’s degree from the University of Santa Clara.
Caserta was first elected to the Santa Clara Council in 2002 and re-elected in 2006 and 2014.
During his tenure on the council, Caserta often clashed with Mayor Lisa Gilmore, particularly over matters related to San Francisco 49’s and Levi’s Stadium, and was also the only council member to vote against City Councilwoman Diana Santana’s deal, who was fired this week.
