A man out California was arrested after he allegedly sexually assaulted a minor girl on a Delta flight out Los Angeles to Orlando.

The girl was sitting apart from her mother, who was facing two queues due to reservation issues. The suspect, Brian Patrick Durning, 51, would then touch another woman.

He blamed his actions on Ambien.

Durning was arrested Friday by federal marshals after Delta flight 2954 landed at Orlando International Airport in Los Angeles (LAX) at 7:30 p.m., according to a criminal complaint filed in the U.S. District Court for the Middle District of Florida and obtained by DailyMail.com.

The man from Altadena, California, was sitting in a wheelchair to the left of the minor, who was not identified and referred to as MV (Minor Victim) in legal records. She is sitting in a middle seat and is described as older than 12, but younger than 16.

The girl’s mother sat two rows in front of both her daughter and Durning because of ‘reservation problems’, according to the complaint.

“Delta continues to cooperate with law enforcement in this matter,” Delta spokesman Morgan Durant said in an email to The Daily Beast.

“We have zero tolerance for this kind of alleged behavior on our flights and at our airports and the accused person is no longer welcome to fly to Delta,” she added.

The rate of reported sexual assaults on aircraft has increased dramatically on an annual basis since 2014, according to data collected by the FBI and shared by Aviation Pros.
