Roger Witthoeft, 33, was already facing charges of alleged slapping a Latin American Gas & Electric worker in San Diego in September and telling him to “speak English you (abusive) immigrant” and “go back to your country”.
Prosecutors say the worker diverted traffic at a Point Loma intersection, where SDG & E workers were repairing a utility box, causing Witthoeft to “get angry” because the worker’s truck stopped at the intersection.
About four months later, Witthoeft clashed with another man on Muir Avenue in Ocean Beach, according to the city attorney’s office.
In that case, she allegedly got angry with the man because he closed a sidewalk with his car. The city attorney’s office said the man was helping a disabled friend get out of the car when Witthoeft met him.
Witthoeft is accused of hitting the victim, hitting him on the ground and then ringing the man’s phone. The city’s prosecutor’s office says the victim contacted prosecutors after reading the hate crime news bulletin.
“Sir. Witthoeft’s contempt for those who differ from him because of their nationality or disability is reprehensible,” said Mara Elliott, the city attorney. “They will be free of violence. This office will fight hard to hold Mr Whithoev accountable.”
Witthoeft, who remains in custody, was arraigned in March on a hate crime case and is due to stand trial in June on charges of aiding and abetting hate crime, as well as violating the victim’s constitutional rights by threatening force.
He is scheduled to be taken to the new case next week on charges of battery and vandalism.
